Business Talent Visa – Subclass 132

The Business Talent visa (subclass 132) is constructed for highly skilled businessmen who are owners or co-owners of a global business venture and are committed to manage a new or existing business in Australia. It is a permanent residency visa for candidates who are nominated by an Australian state or territory government agency. This Visa program is segregated into two sections:

  • Significant Business History stream

For Business owners or co-owners who want to establish their venture in Australia.

  • Venture Capital Entrepreneur stream

For skilled individual who has a business capital fund from Australian Venture Capital Association Limited (AVCAL) member.​


Points to remember before you apply for visa

Expression of interest (EOI)

The applicant must post an Expression of Interest (EOI) via Skill Select program. Potential employers, state, and territories will be then able to check the profile details submitted and judge accordingly for offering the nomination under skilled migration.

The EOI must state the stream under which the applicant wishes to apply. NO documents will be needed at this particular time. The applicant can file the EOI whether he or she is inside or outside Australia.

Passport

An applicant must acquire a valid passport while applying. If any individual does not have any passport till date then he or she must get a new passport before applying. In case a new passport has been acquired post lodging the visa application, all the details of the new passport must be given to one of the Australian Immigration offices.

Basic Requirements

An applicant might be able to get this visa if:

  • you are nominated by a state or territory government
  • are invited to apply
  • you and your family members (whether or not they are included in your application) meet health and character requirements
  • you meet the additional requirements for the stream in which you apply.

Significant Business History stream

You, your partner, or you and your partner combined must have all of the following:

  • total net assets of at least AUD400 000 as the ownership interest in one or more qualifying businesses for least two of the four fiscal years immediately before you are invited to apply and if the qualifying business(es) was a publicly listed company, a shareholding of at least 10 per cent of the total issued capital
  • net business and personal assets of at least AUD1.5 million that are legally acquired and can be transferred to Australia within two years after the visa is granted
  • a total annual turnover of at least AUD3 million in one or more of your main businesses in at least two of the four fiscal years immediately before you are invited to apply
  • ownership of at least:
  • 1) 51 per cent of a business with turnover of less than AUD400 000 per year
    2) 30 per cent of a business with turnover of more than AUD400 000 per year
    3) 10 per cent of a publicly listed company

  • an overall successful business career
  • no involvement in unacceptable business activities
  • a genuine desire to own and maintain a management role in a business in Australia.

You must also be younger than 55 years of age, although a state or territory can waive this requirement if your proposed business will be of exceptional economic benefit to the region where it will operate.

Venture Capital Entrepreneur stream

You must have received at least AUD1 million in funding from an Australian venture capital firm.

The funding must be for the start-up, product commercialisation or business development of a promising high-value business idea.

Health requirements

Applicant must qualify specific health requirements. The health examinations will be based upon few factors like the nation of citizenship, time spent in other nations during the last five years and intended activities in Australia. The health examinations results are mostly valid up to 12 months.

This health examination is mandatory for the applicant and all members of the family mentioned in the visa application.

Candidate can arrange the health examination prior submitting the visa application.

Character requirement

Applicant must qualify specific character requirements. A police clearance certificate from each and every nation, the applicant has resided in for 12 months or more during the past 10 years after you turned 16 years of age have to be submitted. This certificate must be only arranged when asked by the authorities.

This is mandatory for the applicant and all members of the family mentioned in the visa application.

Visa Application Process

Right time for visa application:

  • Either at the time when the employer have filed their nomination, or post nomination
  • Applicant must apply within less than 6 months post nomination approval.

    In case the applicant is 18 years or above, he/she must sign the Australian values statement in order to assure that they will respect the Australian way of life and follow Australian laws. This statement is attached with visa application form.

    Documents preparation

    Candidate must submit all the documents given in the documents checklist to support the claims made in the visa application. Few documents may take a longer time to attain. Hence, the candidate must keep the documents ready at the time of filing the visa application in order to deduct the process delays.

    Document Checklist

    Applicant must submit all the required documents in order to support the visa application. The Immigration authority will judge utilizing the data given at the time of visa application. It is up to the candidate if they wish to submit as much data as possible along with your application.

    Applicant must submit certified copies of the original documents. Original documents must not be given unless until asked. In case the documents are not available in English, then they must be having authorized English translations.

    Personal documents (applicable on all applicants)

    Each and every applicant must submit their latest passport’s biographical pages or any travel documents. In case the name of the applicant has modified or the name of any other person who were added in the visa application has modified will need to submit proofs for the name modification.

    Family relations

    • Birth registration documents for all visa applicants, mentioning both parents’ names will be needed. Appropriate documents consist of but are not restricted to complete birth certificates or any family registration books having both parents’ names. In case any child listed in the visa application is adopted, adoption documents will have to be submitted.
    • Marital certification or Marriage registrations of the applicant and the applicant’s partner or any other person who were added in the visa application, even if they are not migrating to Australia with you will be required. In case the applicant or other person who were added in the visa application are widow, divorced or permanently separated with their partner, must submit death certificate, divorce decree absolute, or statutory declaration/separation certificate as per requirement.
    • In case the applicant is married or into a de-facto relationship, proofs for an authentic and ongoing relationship with the partner must be submitted. In de-facto relationships, the applicant must submit proofs which states that the relationship in active for minimum 12 months at time of visa application. Proofs can consist, but is not restricted to, joint bank account statements, billing accounts in joint names, and other Proofs of cohabitation.

    Children

    • Either authorized copy of birth certificates or the family book stating the both parent’s name of all the children.
    • In case there is an adopted child in the application, authorized copies of adoption documents must be submitted.
    • financial dependency proofs for all the children having age 18 to 23 years in the application:
    •  
      1. authorized copy of birth certificate and relationship proof with the primary applicant
      2. proof related the fact that the children resided within primary applicants’ residence
      3. financial dependency proof for a period of at least 12 months prior visa application

      In case primary applicants’ family is subclass 457 visa holders which were approved on the basis of the primary applicant, then he/she may not require submitting the above mentioned proof.

    • In case the applicant requires to take an 18 years below child to Australia and the child’s other guardian/parent is not listed in the visa application, documentary proofs stating that the primary applicant have a lawful right to take the child to Australia, must be given like:
    •  
      1. Authorized copy of a court-issued parental custody, access or guardianship order
      2. statutory declaration stating permission
      3. Consent form in order to approve the Australian visa for 18 years below child

    Character requirements

    All the family members who are added in the application including the primary applicant needs to submit the Police clearance certificate(s) from the country(s) they have resided in for a time period of 12 months or above in the last 10 years post turning 16 years of age.

    For person who was a part of the army in any country, Military service record or discharge papers for all persons need to be submitted. Police certificates will also be required from the country served.

    Documents under Significant Business History stream

    Skills assessment report along with the visa application must be submitted by the applicant. Kindly note that the skill assessment report must be given before applying for the visa as report submitted after the visa application will not be taken into consideration. Few skill assessment report which are offered under subclass 485 visa, are examined only on the basis of qualification skills and not on the professional experience. Due to which such kind of skills assessment reports are not suitable for stating skills for the ENS program.

    Skills and qualifications

    • Proofs to state that applicant’s skill assessment has been approved from the related assessing authorities for nominated occupation and the assessment report is not taken for a subclass 485 visa
    • Applicant’s detailed curriculum vitae (CV)
    • Authorized copy of entire qualifications and professional experience documents
    • In case required, Registration, licensing or professional membership documents for the nominated occupation which is available in the state or territory, applicant will be employed must be submitted. Documents from the Australian registration and licensing authority, stating that the applicant qualifies or will be qualifying the needful criteria of the authorities will be submitted. Those documents must mention the following:
    •  
      1. Registration/licensing type
      2. Registration/licensing authority’s name and contact details

    • In case the applicant’s skill requirement has been spared, he/she must submit proof stating any one of the following:
    •  
      1. Applicant is a researcher, scientist or technical specialist at ANZSCO skill level 1 or 2 and will be employed at Australian government research agency.
      2. Applicant is an academic, working at an academic level of A, B, C, D or E under an Australian university.
      3. Applicant will be earning equivalent to, or higher than the top individual income tax rate as stated by the Australian Taxation Office.

    • In case the applicant is a citizen of New Zealand or a family member of any New Zealand citizen, have being in Australia under Special Category visa (subclass 444) or under New Zealand Citizen Family Relationship visa (subclass 461) and have a working experience of 2 years under the nominating employer prior the visa application:
    •  
      1. Detailed declaration from the employer stating that the applicant have acquired minimum 2 years of working experience under them ( The document must include working tenure, paid leaves taken detail, unpaid leaves take details, international tour details for work or training purpose)
      2. Tax assessment notices proof for a period of 2 years
      3. PAYG payment summaries during the employment tenure of 2 years
      4. Pay slip documents
      5. Leave record in details

    Age

    The Applicant must be below the age of 50 years while applying for visa. And, in case the applicant is spared from the above requirement, he/she must submit proof related any of the following points:

    • Applicant is a researcher, scientist or technical specialist at ANZSCO skill level 1 or 2 and will be employed at Australian government research agency.
    • Applicant is an academic, working at an academic level of A, B, C, D or E under an Australian university.
    • Applicant is appointed under the designation of a medical practitioner with a working experience of minimum 4 years in the nominated job profile while being subclass 422 visa holder prior applying for visa. From which minimum 2 years of employment must be situated in Australia’s regional area
    • Applicant is appointed under the designation of a medical practitioner who have a working experience under the nominated occupation while being a 422 visa holder prior being subclass 457 visa holder for a time period of 2 years within 4 years prior applying for the visa. From which minimum 2 years of employment must be situated in Australia’s regional area
    • Applicant is a subclass 444 visa holder (citizen of New Zealand) or Subclass 461 visa holder (family member of New Zealand citizen) and have working experience under the employer who offered the nomination of minimum 2 years in the last 3 years prior applying for the visa.

    English language proficiency

    An authorized English language examination report conducted less than 3 years before visa application, stating that the applicant has acquired minimum competent level of English must be submitted. In order to state that the applicant qualifies the competent level of English, he/she must submit proof for any one of the following statement:

    • Applicant acquired a valid passport provided by the UK, USA, Canada, New Zealand or the Republic of Ireland and proofs stating that the applicant is a citizen of the same country.
    • An IELTS test score of minimum 6 bands in each of the module (speaking, reading, listening and writing) conducted within the 3 years prior visa application.
    • An OET, Occupational English Test score of minimum ‘B’ in each of the four test sections conducted within the 3 years prior visa application.
    • TOEFL iBT (Test of English as a Foreign Language internet-based test) minimum score of 12 in listening, 13 in reading, 21 in writing and 18 in speaking conducted within the 3 years prior visa application.
    • PTE (Pearson Test of English) minimum score of 50 in each test level (speaking, reading, listening and writing) conducted within the 3 years prior visa application.
    • CAE (Cambridge English: Advanced) minimum score of 169 in each level (speaking, reading, listening and writing) conducted on or post 1 January 2015 and prior visa application.
    •  

      In case the applicant is spared from the English language requirement, he/she must submit proof stating that one of the following statement is applicable:

    • Applicant will be earning equivalent to, or higher than the top individual income tax rate as stated by the Australian Taxation Office. Kindly note that in case, the applicant don’t hold functional English, they will have to pay the second installment of the visa application charges.
    •  

      For applicants included in the list and are aged 18 years or above while applying for the visa, any one of the following statement must be fulfilled:

      (It is not mandatory to submit the proofs while you are applying for the visa but the visa application will not be approved until unless the proofs are been submitted)

    • Applicant acquires functional English.
    • In case the applicant doesn’t have minimum of functional English, second installment of the visa application charges will be paid.

    Documents under Venture Capital Entrepreneur stream

    Applicant must submit the given documents at the time of filing visa application under the Temporary Residence Transition stream.

    Skills and qualifications

    Under this stream, the skills are not examined as the applicant have already acquired a 2 years working experience under the nominating employer in Australia.

    In case required, Registration, licensing or professional membership documents for the nominated occupation which is available in the state or territory, applicant will be employed must be submitted. Documents from the Australian registration and licensing authority, stating that the applicant qualifies or will be qualifying the needful criteria of the authorities will be submitted. Those documents must mention the following:

     
    1. Registration/licensing type
    2. Registration/licensing authority’s name and contact details

    Age

      In case the applicant is spared from the English language requirement, he/she must submit proof stating that one of the following statement is applicable:

    • Applicant will be earning equivalent to, or higher than the top individual income tax rate as stated by the Australian Taxation Office. Kindly note that in case, the applicant don’t hold functional English, they will have to pay the second installment of the visa application charges.
    • Applicant has acquired minimum 5 years of full-time education under a secondary/higher academic institution where the learning language was English.
    •  

      For applicants included in the list and are aged 18 years or above while applying for the visa, any one of the following statement must be fulfilled:

      (It is not mandatory to submit the proofs while you are applying for the visa but the visa application will not be approved until unless the proofs are been submitted)

    • Applicant acquires functional English.
    • In case the applicant doesn’t have minimum of functional English, second installment of the visa application charges will be paid.

    Online application

    Applicant must submit complete related documents and complete payment for the visa application charges via credit card at the time of visa application.

    Applicant must upload the required documents by utilizing his or her own ImmiAccount at the time of filling the online visa application. This will benefit in deduction of delays in process.

    Post Application

    Post submitting the visa application and the required documents, the authorities will provide an acknowledgment that they have received your data.

    The visa application can be tracked and managed by utilizing Immi Account.

    Waiting for Final decision

    Candidate must note that the visa application might take longer duration in case the candidate requires character or health certifications or to add some additional data.

    Priority processing arrangements applies in the processing of visa application. It states the sequence in which the authority takes the application into consideration regardless of the time, applications were filed.

    Outside Australia:

    In case the candidate have applied outside Australia, they must not travel to Australia until they are said so in written that their visa has been granted. Applicant must wait for the final decision from the authority prior leaving the job, selling home or booking any travel package.

    Inside Australia:

    Final Visa Decision

    In case visa is granted, the Australian immigration authorities will provide information related:

    • visa grant number
    • conditions related to the visa

    In case visa is not granted, the Australian immigration authorities will provide information related:

    • why visa has not granted
    • review rights of the applicant (if present)
    • application time limit for the decision review (if present)

    Visa application process Cost

    In case the applicant is making the payment for the visa application via credit card, a surcharge will be applied.

    The present surcharge rates are:

    • Visa and MasterCard* – 0.98%
    • American Express and JCB – 1.4%
    • Diners Club International – 1.99%

    NOTE: The surcharge rate will also be applicable on Debit Visa cards and Debit Master Cards at the time of online payments.

    visa costs modifies with time. Cost is based upon the date on which the immigration authorities have received the visa application. In case there is a price rise in between the filing date and the date on which the immigration authorities have received the visa application, the applicant will have to pay the modified application charge.

    This visa application charge is taken in the form of Australian dollars (AUD) that to be paid for the visa application. In few cases the visa application charge can be NIL as well.

    Second installment

    Applicant must pay the second installment for all family member added in the application that are:

    • 18 years of age or above
    • Not having functional English

    This charge has to be paid by the applicant prior visa grant.

    Other costs

    Applicant may need to pay the other costs, including health assessments costs, police certificates costs, or other certificates or tests costs. The applicant is alone responsible for organizing the needful requirements.

    Benefits

    Subclass 132 is a form of a permanent residency visa. It allows the primary applicant and his or her family members whose visa grant has been approved to:

    • Reside in Australia permanently
    • Get employment and education in Australia
    • Get registered in Medicare which is Australia’s program for health care and related expenditure.
    • apply for citizenship in Australia, in case the applicant is eligible
    • nominate/sponsor family relatives who are eligible for permanent residency
    • travel to and fro in Australia for a period of 5 years counting from the date of visa grant
